To: HON. JUDGE JAMES BOROWSKI, BREWSTER SE TOWN CT.
Anna Nicole Bruno is to appear in Brewster NY Town Court on January 11, 2006, to answer charges that she brutally beat a horse about the head and face with a chain, to the point of causing it severe injury. The case is before South-East Town Justice Hon. Judge James Borowski. The Case # is 05120443.
PLEASE TAKE NOTICE THAT WE petition the judge, the prosecutor and the jury (if any) that if they should so find the evidence sufficient for a guilty verdit, that the offender, Anna Nicole Bruno, be prosecuted to the full extent of New York State Agricultural & Markets Law ss353, ("Buster's Law")which covers,"Overdriving, torturing and injuring animals and failure to provide proper sustenance." It provides that: "A person who overdrives, overloads, tortures or cruelly beats or unjustifiably injures, maims, mutilates or kills any animal, whether wild or tame, and whether belonging to himself or to another, or deprives any animal of necessary sustenance, food or drink, or neglects or refuses to furnish it such sustenance or drink, or causes, procures or permits any animal to be overdriven, overloaded, tortured, cruelly beaten, or unjustifiably injured, maimed, mutilated or killed, or to be deprived of necessary food or drink, or who
wilfully sets on foot, instigates, engages in, or in any way furthers
any act of cruelty to any animal, or any act tending to produce such
cruelty, is guilty of a misdemeanor, punishable by imprisonment for
not more than one year, or by a fine of not more than one thousand
dollars, or by both."
WHEREFORE, We pray the Court, in weighing all factors of the case, to exersize its judicial power and discretion "in a light most favorable" to the animal, as it is the animal the law is made to protect. They cannot speak for themselves so is incumbant upon the courts, the prosecutors, and the system to speak for them. Please Judge, dont let the animals down. If a guilty verdit is warranted in this case, please prosecute to the full extent of the law. People need to know that behavior like this is un-acceptable in todays society, despite all the violence they may see in the media; Americans will never realize how totally unacceptable violent behavior towards animals truley is,...unless the police and the judicial system rule accordingly. You will not be doing society any favors by letting offenders off the hook with a proverbial "slap on the wrist". If the evidence warrants it, please throw the book at this one.
Sincerely,
The Undersigned
